Terms of Service

Please read the following Terms of Service carefully before signing up for any Service provided by DrGadget.ae ("Service Provider"). Content of these Terms may change without prior notice, and shall be effective as soon as posted herein.

By using the service and submitting your device for repair, the "Client" agrees to the following:

1. Commencement of Service

The Client shall log on to DrGadget.ae and fill out the service form with accurate device information as follows: Brand, Model, Network, Memory, Color, and Problem.

The Client is required to provide accurate information that corresponds to the actual problem of the device. Inconsistencies shall result in revocation of the free delivery feature.

The Client shall supply accurate contact information such as Name, Address, Phone Number, Email Address, and the device's IMEI Number.

The Service Provider is dedicated to protecting the Client's personal data from any unauthorized access and shall not use the information for any purpose beyond the service transaction. However, it is the Client's responsibility to create a data back-up as the Service Provider shall not be held responsible for loss of data.

The Service Provider reserves the right to refuse service if the device

  • lacks IMEI number.
  • Is blocked or jail-broken.

The Client shall provide a brief description as well as other pertinent remarks regarding the problem of the device. A final, non-negotiable quotation shall then be provided to the Client as basis of payment.

2. Pick Up and Delivery

All services will include free pick and delivery service. The courier shall pick up the subject device for repair and transport it to the DrGadget.ae service center.

After repair, the device shall be delivered back free of charge to the address registered in the online form. As the Client is required to supply accurate device information at the onset of the transaction, the free delivery feature of the service shall then be considered void should there be inconsistencies between the provided information and the actual problem. In this regard, the Client shall shoulder courier fees for delivery of the device.

The Client shall ensure proper packaging and sealing before handing over the device to the courier. In the event that separate parts are included, the Service Provider shall not be held liable for any loss incurred due to improper packaging. Therefore, the Client agrees that they are sending the separate parts at their own risk.

3. Repair

The Service Provider shall endeavor to resolve only the problem indicated in the online service form. It is therefore imperative that accurate and consistent information be provided to the Service Provider.

For devices purchased from affiliate sites, the Service Provider shall repair devices free of cost provided that:

  • The device is still covered by store warranty
  • The device has not been submitted for service to other repair centers after purchase

For waterproof devices, the Service Provider cannot guarantee that the device will still be waterproof after repair due to the inevitability of opening the original seal.

For devices submitted for water damage repair, the Service Provider shall not be responsible for further damages caused by progressive corrosion.

4. Payment

The amount indicated in the initial quotation shall be considered final, provided that the information provided by the Client corresponds to DrGadget's assessment. Should there be no inconsistencies, no further price adjustments shall be made for the particular transaction, as the Service Provider shall only endeavor to repair problems indicated in the online service form.

Payment shall be made via cash on delivery or credit on delivery.

Payment must be made within 30 days upon completion of repair works in order to proceed with delivery. In the event that payment has not been settled within the said amount of time, the Service Provider reserves the right to dispose of the device as it sees fit.

5. Warranty

Should the device encounter the same issues post-repair, the Client is entitled to a 30-day warranty during which the Service Provider shall render additional work free of charge. This warranty only covers the recurrence of the initial problem.

The Service Provider's after-service warranty does not cover the following conditions:

  • Body or frame damage caused by mishandling
  • Water damage
  • Damage from subsequent vertical falls, whether intentional or otherwise
  • Internal hardware tampering
  • Damage resulting from DIY repairs
  • Software issues unrelated to the repair
  • New damages unrelated to the original repair
  • Any loss of data occurring as a result of the repair

After-service warranty does not cover devices with the following pre-existing conditions prior to submission for repair:

  • Device has known manufacturing and/or performance issues separate from the main issue being repaired;
  • Device has a noted frame damage;
  • Device is water-damaged
  • Device has a tampered internal hardware system.
  • Once the tamper-proof seal has been broken, the 30-day post-repair warranty is considered void.

The warranty shall be considered void in the event that the Client submits the device for repair to other parties during the warranty period.

The Service Provider shall provide warranty for replacement parts. The period of warranty shall vary depending on the replacement parts installed in the device.

6. DrGadget.ae Warranty Card

For irreparable devices covered by Warranty Card, DrGadget.ae shall replace them for FREE if:

  • The Client has not submitted the device for repair to any other service centers.
  • The tamper-proof seal is still intact.
  • The proof of purchase (original official receipt) is presented upon submission of the device.
  • Warranty exclusion factors stipulated in Section V, Clause B also apply to the 1 Year Replacement Warranty.

7. Limitations of Service

The Service Provider and/or its third party service providers shall not be liable for a device's performance failure. In the event that the Service Provider determines that a device's technical needs are beyond the scope of service, the Service Provider reserves the right to refuse service, and in extreme cases, provide refunds.

8. Indemnification

Customer agrees to indemnify, defend, and hold the Service Provider free from and against any and all losses, costs, obligations, liabilities, damages, actions, suits, causes of action, claims, demands, liens, encumbrances, security interests, settlements, judgments, and other related expenses of whatever type or nature, including, but not limited to, damage or destruction to property, injury (including death) to any person or persons, which are asserted against, incurred, imposed upon or suffered by the Service Provider by reason of, or arising from

  • Client's breach of these Terms;
  • Client's actual or alleged infringement of any brand property;
  • Client's actual or alleged failure to promptly pay sums due;
  • Client's failure to comply with applicable laws, regulations or ordinances;
  • Acts or omissions of Client (or its officers, directors, employees or agents).

9. Disclaimer of Warranties

The Service Provider expressly disclaims warranties of any kind, as service is provided on an "as is" and "as available" basis. available" basis, and consequential damages shall not be the responsibility of the Service Provider.

The Service Provider makes no warranty that the service will be uninterrupted or error-free, hence the Service Provider does not make any warranty as to the reliability of results or material/data downloaded that may be obtained through the service. The Service Provider shall not be held liable for loss of data or any irreversible further damage as the Client is submitting the device at his own risk.

10. Termination

Either Client or Service Provider may immediately terminate the Service upon written notice to the other party. Upon termination of the Service, Client's right to use the service immediately ceases, as well as any obligations of the Service Provider to the Client.

11. Applicable Laws

The Service Terms shall be governed by and construed in accordance with the laws of Dubai, excluding its conflict of law provisions. Both parties agree to submit to the exclusive jurisdiction of the courts in Dubai, and agree that any cause of action arising out of or related to this Service must commence within one (1) year after the cause of action arose; otherwise, such cause of action is permanently barred.
